Net Creations Ltd - Terms and Conditions
Below are the current Terms and Conditions for Net Creations Ltd. Hosting NZ is a division of Net Creations Ltd. Please read the Terms and Conditions carefully.
1. Acceptance of Terms and Conditions
By accepting these terms and conditions you agree to abide by Net Creations Terms and Conditions together with such modifications and updates to it as may be issued by Net Creations from time to time. Failure to follow such Terms and Conditions may result in our services being immediately suspended without notice until such time as your site again complies with the policies.
Net Creations reserves the right to vary the service agreement at anytime. Such variation will become effective 30 days after a notice of the variation to you.
Continued use of the service by you after the effective date will constitute acceptance of the variation by you.
2. Service Charges
Net Creations Ltd reserves the right to amend prices of hosting or any other ongoing services with one months notice in writing of its intention to change such charges. Price changes, other than hosting and content management services, shall not be made to a contract of service, once quoted and accepted by the client, other than for agreed charges to the web page design or content.
2.1 Website Hosting
Net Creations Ltd offers three billing cycles; three months, six months and 12 months. Invoices will be sent at the start of the agreed term of website completion. Hosting invoices are to be paid in advance of services. Hosting charges are based on a websites monthly usage and web space on the server. The invoiced amount may vary monthly depending on Net Creations pricing structure.
2.2 Conduct
You agree not to send mass unsolicited mailings. You shall not use the services offered for any illegal activity including hosting websites. You accept full responsibility for any activity that occurs using your account and agree to be liable for any charges incurred.
2.3 Domain Names
Net Creations Ltd will invoice clients for the annual renewal of their domain name(s) at the start of the month prior to the expiry month of the domain name.
When a Domain name is registered you, or in your name as directed by you, you then agree that the following information becomes publically available:
i) Your name
ii) Contact details
iii) The start and expiry dates, name servers and the Net Creations business name
3. Cancellation Policy:
Net Creations Ltd reserves the right to receive one month’s notification of cancellation of any services from the client. If a development contract has been engaged Net Creations reserves the right to invoice the client for work completed up to the cancellation date. The client must also provide a cancellation date.
4. Late Payment or Non Payment:
Payment is to be received in full no later than the 20th of the following month after receipt of invoice. If payment is not received by the due date, client services may be discontinued without further notice. Domain name charges that are not paid in full will be automatically cancelled and a reactivation charge of $50 will be incurred by the client. Net Creations Ltd gives no undertaking that if a domain name has been cancelled due to non payment, the same domain name will be available again should it be requested.
5. Copyright and Intellectual Property:
The client retains ownership to all graphics and content provided by Net Creations as the final development. All concept artwork, source code and files will remain the property of Net Creations Ltd. Net Creations Ltd retains the right to use client material for promotional purposes.
6. Development / Designer Credit:
Unless otherwise arranged, a link to Net Creations Ltd website will appear in either small print or as a graphic at the bottom of every page of the client’s website. Any graphic used will be designed to match the site design.
7. Website Content:
Net Creations Ltd offers its services for lawful purposes only. Storage, transmission or presentation of any information in violation of any New Zealand law is prohibited. This is not limited by copy right material and includes intellectual rights. Any explicit, objectionable or illegal sex related material is prohibited on any account.
8. Access:
If the clients website is to be installed on a third party server, Net Creations Ltd must be granted access rights to the chosen server via (ftp). Other access rights may need to be granted depending on the nature and needs of the project.
9. E-Commerce:
Net Creations Ltd does not accept responsibility for secure internet hosting for credit card transactions or fund transferring. Net Creations Ltd does not accept responsibility for clients who pass on their secure services account details to third parties. Any misuse of the service is the sole responsibility of the secure hosted client. Net Creations Ltd is not responsible or liable for misuse, abuse or removal of a client’s e-commerce related activity. The client accepts they are the provider to their own customers and will not hold Net Creations Ltd responsible for issues pertaining to fraudulent charges.
10. Limitation of Liability and Indemnity:
Net Creations assumes no liability for content of websites. You agree that all liability and responsibility of Net Creations to you or any other person under these terms and Conditions is excluded regardless of any liability occurring. You agree to the maximum extent permitted by law any and all liability and responsibility of Net Creations to you or any other person under or in connection with these terms and Conditions. Net Creations liability and responsibility is excluded in respect of any claim of damages.
11. Expressions:
The following words and expressions shall have meanings hereby assigned to them except where the context otherwise requires: “Net Creations Ltd”, “Net Creations”, “us”, “we” and “our” means Net Creations Limited. ”Service”, “Hosting” means the internet hosting provided by Net Creations Ltd. ”You” and “Your” means the party or company whom enter into the agreement with Net Creations Ltd.
